Terms of Service

These terms are an agreement between you and Brightmonzon Corp (“NELY”, “we”), Miami, Florida, for the NELY app.

What NELY is

  • NELY is a marketplace app. It connects people who need help at home (clients) with independent helpers.
  • NELY is not a service provider. NELY does not do the jobs, does not employ helpers and does not supervise their work.
  • Helpers are independent contractors. Each helper sets their own price and decides which jobs to take.

Who can use NELY

  • You must be at least 18 years old.
  • You must give true information and keep your account secure. One account per person.
  • Helpers must verify their identity with Stripe Identity before they can receive jobs.

Booking

  • A client posts a request. Helpers can send offers.
  • A booking exists only when the client accepts an offer. Before that, nothing is booked and nothing is charged.
  • The helper and the client are responsible for agreeing on the details of the job in the app.

Prices and payment

  • The client pays the helper’s price plus the card processing fee (currently 2.9% + $0.30). The total is shown before you book.
  • NELY takes zero commission from the helper’s price and charges clients no service fee.
  • Your card is held when the job is booked (for scheduled jobs, 24 hours before the start) and charged when you confirm the job is done, or automatically 24 hours after the helper marks it done.
  • Tips are optional and go 100% to the helper.
  • All payments are processed by Stripe. Never pay or accept payment outside the app.
  • Cancellations follow the Cancellation & Refund Policy.

Jobs that are not allowed

  • No work that needs a Florida state or county license, including electrical, plumbing, HVAC, roofing, gas, pest control, structural or other licensed trade work.
  • No illegal, dangerous or adult services. No jobs involving weapons, drugs or alcohol.
  • Helpers must refuse any job that needs a license they do not have.

Your conduct

  • You agree to follow the Community Rules.
  • Reviews must be honest and about a real job.

Suspension and closing accounts

  • We may suspend or close an account that breaks these terms or the Community Rules, puts someone at risk, or is used for fraud.
  • You can delete your account at any time in Profile.

Liability

  • The work is done by the helper, not by NELY. Helpers are responsible for their own work.
  • To the extent permitted by law, NELY’s total liability for any claim about a job is limited to the amount you paid for that job.
  • Nothing in these terms limits rights you have under law that cannot be limited.

Law and disputes

  • These terms are governed by the laws of the State of Florida.
  • Disputes go to the state or federal courts located in Miami-Dade County, Florida.
  • Before going to court, please write to support@nelyapp.com so we can try to solve it.

Changes

  • We may update these terms. When we do, the app shows the new version and asks you to accept it before you continue.
